This complaint is in reference to Westlake Financial Services account number XXXX Westlake Financial violated the Fair Debt Collection Practices Act, 805 ( b ) which states " Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. Westlake called my friend regarding the repossession of my vehicle after I stated to them over the phone that I did not have the funds to pay to get the vehicle back. In an effort to continue collection, they did this without my express permission, nor with my knowledge. I don't know how they got her number, but she informed me that she got a phone call at XXXX XXXX on Thursday, XX/XX/2023 from them, from the phone number XXXX. They called me 20 minutes later, at which point I answered and informed the caller on the recorded line of their above referenced violation, that this violation will be taken seriously, and that I will be reporting them to the CFBP.
