On XX/XX/XXXX, I received a letter from the Texas Attorney General 's Office stating that I was delinquent on a student loan ( serviced by the Texas Higher Education Coordinating Board " THECB '' ) and if not paid in full ( {$9800.00} ), the Attorney General would file a suit against me on the behalf of the State of Texas. The letter was dated XXXX XXXX XXXX. This was the first I knew of this loan being delinquent and had thought until that point that it was in deferment. I called the THECB on XX/XX/XXXX and left a voicemail and asked to be called back. I spoke with them on XX/XX/XXXX and they transferred me to the Texas Attorney General 's Office. Before transferring me, I asked what address they had on file because I hadn't received any sort of notification from them about the loan being delinquent. They gave me my current address but did admit that it was recently updated in their system at the beginning of XXXX which means if they did send any prior notifications, they went to the wrong address. I live in XXXX now and have not lived in XXXX for many years. I spoke with XXXX in the Attorney General 's Office and I attempted to set up an affordable payment plan but I was informed I must pay it in full or they would file a law suit against me. I explained that I hadn't gotten any prior notifications and could not afford to pay the loan in full but could make smaller monthly payments until it is paid off. XXXX reiterated that that was not an option and followed up with an email giving me the following two options : " Option A : Pay {$9800.00} on or before XX/XX/ or Option B : Pay two installments of {$5100.00} each- 1st installment due on or before XX/XX/, and final installment due on or before XX/XX/. ( These two installments include the monthly minimum {$170.00} due on the XXXX of each month. ) '' I am unable to afford the options the Attorney General 's Office have given me but am more than willing to set up more affordable payments but am being told that is not an option. Additionally, I now live in XXXX and would be unable to appear in court if they file a suit in XXXX.
