This matter centers on a credit card I had with XXXX XXXX which I had paid off in XXXX. Some time later, I learned XXXX XXXX was reporting a balance owed. XXXX XXXX and I were in contact in XX/XX/XXXX about how to resolve the issue. On XX/XX/XXXX I received a letter via USPS regular mail from Hunt & Henriques, LLC ( see attachment # 1 ). This letter notified me of their intention to file suit against me, with no instructions or opportunity to discuss or remedy. This letter also informed me that Hunt & Henriques are not legally licensed in California as debt collectors. The letter is not signed by an attorney, the name is crossed out and the name of XXXX XXXX is handwritten in the salutation. On XX/XX/XXXX, XXXX days following receipt of their letter, I sent a validation notice response to Hunt & Henriques via USPS Certified Mail. According to USPS tracking website, my letter was delivered and received by an individual at Hunt & Henriques on XX/XX/XXXX. ( See attached letter, USPS receipt for transmittal and USPS tracking printout confirming my letter delivered to an individual at XXXX XXXX on XX/XX/XXXX attachments 2, 3 and 4 ). . My validation notice to Hunt & Henriques sought validate information as provided for me as a consumer by the FDCPA. Specifically, 1 ) Verification of the creditor they claim to represent. 2 ) Validation of the basis for the debt. 3 ) Provide a copy of the last billing attempt by their alleged client. 4 ) Verify what payments may have been made since the last billing. 5 ) Verification that Hunt & Henriquez have a debt collection license in the State of California. 6 ) Notifying them I disputed the debt. As of today, XX/XX/XXXX, Hunt & Henriques LLP has not responded to my validation notice. Their failure to respond to me within 30 days is a violation of my rights as a consumer according to the FDCPA. Instead, they chose to file a complaint in XXXX XXXX XXXX XXXX XXXX XXXX California XXXX XXXX of XXXX, Case # XXXX attached ) on XX/XX/XXXX. I was served at home in front of my wife and children. I consider this to be an attempt to intimidate, harass and coerce me into paying an unverified debt they are not licensed to collect. As required, I have filed my response to my to their complaint on XX/XX/XXXX ( attached ). In addition to this response, I am filing complaints with the CFPB and Attorney General of the State of California.
