Consumer Narrative

I have not authorized the use of my personal information in writing to the credit reporting agencies mainly XXXX XXXX and Experian.. Though they have purchase information from other furnishing agencies as Well this ultimately amounts to identify theft. All of the entries in the report are inaccurate and the statue has expired on most which again proves the inaccurate unauthorized nature of the agencies reporting practices Anything listed in a consumers credit report must be verified and validated by the reporting agency. And must be verified in writing by the consumer or employee. This must consist of several factors : number one ( 1 ) There was no validation of the debt by actual accounting ( 2 ) There was no validation of each creditor 's claim against XXXX XXXX. ( 3 ) : No signed invoices ( 4. ) There was no binding contract by both parties sent by certified mail so that your verification of the delivery has been made by a unbiased party. ( 5 ). There is no wet ink signature by both parties ( 6 ) or XXXX XXXX XXXX XXXX was not told that she was creating a contract with her wet signature because there is none. A contract or a signature on her behalf or theirs a contract can not be made by a soulless legal fiction therefore this did not take place. Therefore no legal entities or a third party can collect on their behalf. Their failure to provide proof of the aforementioned documents will constitute fraud and identity theft as well as a violation of my civil rights and an illegal violation of my right to privacy.. Per the fair credit act statute The credit reporting agencies have improperly and unlawfully reported things in my consumer credit report that are erroneously reported and not verified to report ( all information on the report is inaccurate as well as illegally. These and accuracy is have drastically change the quality of my life for the worse. I also have entries that are erroneously reported that belong to a male that has nothing to do with my report ..The files appear to have been merged based on a possible different address ..There was never the slightest attempt to contact me prior to reporting which is lawful per statute 602 of the Fair credit act. merged credit file occurs when a CRA totally combines the credit files of two or more different consumers into a single credit file so that ( a ) one consumer has a trove of personal and account information in his or her credit file ( and on his or her credit reports ) that does not and never did belong to that consumer, and ( b ) another consumer 's entire credit history essentially disappears because a credit bureau has placed all ( or nearly all ) information that should be in the consumer 's credit file into the file of another consumer. A merged file, in other words, happens when XXXX, Experian, XXXX, or XXXX places information that belongs to XXXX ( or more ) separate individuals into the credit file of just XXXX of those individuals. As such there is a merged file, the credit file of XXXX or other individuals can be totally or nearly merged out of existence. Mixed and Merged Credit Files are a well-recognized issue at all major credit bureaus Generally, because credit bureaus like XXXX, Experian, and XXXX -- in violation of 1681e ( b ) of the Fair Credit Reporting Act ( FCRA ) -- fail to follow reasonable procedures to assure maximum possible accuracy of information that these CRAs report about consumers, mixed and merged credit files have been a well-recognized and frequently prosecuted problem for decades. Recently, the New York Attorney General filed charges and settled claims with XXXX, Experian, and XXXX concerning, among other issues, the prevalence of mixed files. The settlement agreement between the New York Attorney General and XXXX, Experian, and XXXX, dated XX/XX/2015, If these inaccuracies are not removed I am entitled to compensation of XXXX $ per occurrence if the information is not deleted. To protect my rights to maximum possible accuracy of information on your consumer reports ( based on common law defamation principles ) and to assure that only people who should see consumer reports about you do see consumer reports about you ( based on common law privacy principles ), the FCRA lays down the rules of the road for the credit bureaus, the companies that furnish information to credit bureaus, called furnishers, and companies that purchase consumer reports about you, called users. These agencies have not ever contacted me ever per the fair credit act statute in writing or via any other form of communication. There was not ever a contract or signature provided to report these facts or to validate their existence and or other which directly violated my personal professional and constitutional and privacy rights. Furthermore The credit reporting agency once furnished with the illegal and inaccurate information may cause a file to be inaccurate and a merged file not only constitutes identity theft for one but also violates the right to privacy of information for all parties involved. Please remove all entries from my report without hesitation.. from this day forward.
