Consumer Narrative
Dear CFPB, I am a natural person and a living human being, and I am entitled to certain rights under the Fair Credit Reporting Act and 15 USC 1681. I am writing to file a formal complaint about several items on my credit report that I believe are in violation of my rights. The consumer reporting agencies that compiled this report are governed by 15 USC 1681, and I believe they have violated my rights several times. I did not give the consumer reporting agencies permission to furnish the following accounts, and I demand that they be deleted immediately in accordance with the Fair Credit Reporting Act : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX I believe that the consumer reporting agencies have violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Specifically, 15 U.S.C 1681 section 602 A guarantees me the right to privacy, and 15 U.S.C 1681 Section 604 A Section 2 states that a consumer reporting agency can not furnish an account without my written instructions. Additionally, 15 U.S.C 1681c. ( a ) ( 5 ) Section prohibits consumer reporting agencies from making consumer reports containing adverse information, other than records of convictions of crimes which antedates the report by more than seven years. Finally, 15 U.S.C. 1681s-2 ( A ) ( 1 ) states that a person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. Furthermore, I have noticed several billing errors on my credit report that violate the United States Code Law ( TILA 15 U.S. Code 1666 ( b ) billing error ). Specifically, I have noticed errors under 15 U.S. Code 1666 ( b ) billing error ( 4 ) The creditors failure to reflect properly on a statement a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. As I know the creditor didnt notify me 21 days before with a statement, there should be no late payments on these accounts. I demand to see hard solid proof from the creditor bank account that I didnt pay and was marked late because this is clearly a billing error. The following items should all be updated as agreed on my consumer report : USDOE/XXXXXXXX XXXX XXXX XXXX XXXX XXXXXXXX Under the law, these accounts must be updated immediately, or I will seek monetary compensation for violation of my rights in small claims court in my city and state under 15 USC 1681n civil liability because I have been violated . Additionally, I have already filed a complaint with the Complaint portal for the State Attorney Generals Office, XXXX XXXX XXXX, and Federal Trade Commission. Finally, I would like to add that I did not authorize the following companies to look at or pull my credit, and these inquiries are fraudulent : XXXX XX/XX/2021 XXXX I demand that these inquiries be removed today, as I have contacted these companies and they have no proof that I have authorized these.
