I, hereby declare under penalty of perjury that I am the victim of identity theft. In Match, 2023, I discovered that someone had obtained my personal information without my authorization and used it to apply for credit, resulting in the following inquiries on my credit report : I did not initiate or authorize these credit inquiries, and I believe they are the result of fraudulent activity committed by the identity thief. I am submitting this identity theft affidavit to request that the credit reporting agencies remove these inquiries from my credit report, as they are not a true reflection of my credit history. Additionally, I am disputing negative marks regarding open credit accounts that were reported on my credit report by XXXX, Experian, and XXXX. I believe that this information should not have been included on my credit report under the provisions of the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S. Code 1681a ( 2 ) ( A ) ( i ). As you are aware, this provision excludes from the definition of a consumer report any report that contains information solely as to transactions or experiences between the consumer and the person making the report. In my case, the negative mark that was reported relates solely to a transaction or experience between me and the creditor, and therefore should not have been included on my credit report. Under these provisions, I have the right to dispute any billing errors or unauthorized charges that may have been applied to my account and those accounts should accurately reflect my true account status until the disputes are settled, to the satisfaction of the consumer. I have already initiated the dispute process with the creditor, and have provided all relevant documentation to support my claim. Given the facts presented above, I am requesting that you remove the negative mark from my credit report as soon as possible. As the negative mark was included in error, I trust that you will take prompt action to correct this mistake and ensure that it does not happen again in the future.
