My name is XXXX XXXX and all information stated below is to be accounted for as my personal statement. My identity and personal credit report were used without my knowledge or consent. The reporting of this information is in violation of the FCDPA 15 USC 1692c 805 ( b ) Which states : " Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a post judgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector '' My personal credit file is displaying information that is fraudulent and I have attached the Identity theft report as required by FCRA 605B ( 15 U.S.C. 1681c-2 ), Subsection ( b ) ( a ) Block. Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer.
