Equifax has caused me physical, mental & financial anguish by violating my rights as a consumer. Equifax reports serious delinquent payments with company XXXX on my credit report for the dates of XX/XX/XXXX, XX/XX/XXXX, & XX/XX/XXXX, which is incorrect. I have tried ( 6 ) times to resolve this matter with Equifax to no avail. Equifax is in violation, and must acknowledge law- - [ 15 U.S.C. 1681 ] ( a ) Accuracy and fairness of credit reporting. The Congress makes the fol- lowing findings : ( 1 ) The banking system is dependent upon fair and accurate credit report- ing. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. ( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. -15 U.S.C. 1681s-2 ( a ) ]. Responsibilities of furnishers of information to consumer reporting agencies. ( A ) Reporting information with actual knowledge of errors. A person shall not furnish a ny information relating to a consumer to a consumer reporting agency if a person knows or has reasonable cause to believe the information is inaccurate. [ 15 U.S.C. 1681s-2 ( a ) 1 ] ( 2 ) Penalties ( A ) Knowing Violations. Except as otherwise provided by subtitle B of the Consumer Financial Protection Act of 2010, in the event of a knowing violation, which constitutes a pattern or practice of violations of this title, the Federal Trade Commis- sion may commence a civil action to recover a civil penalty in a district court of the United States against any person that 72 violates this title. In such action, such person shall be liable for a civil penalty of not more than {$2500.00} per violation.
