On XX/XX/28 the vehicle was repossessed from my home. I woke up to go to work at XXXX and noticed my vehicle was not there. I was told by an agent at the bank that after paying 2 payments a few days prior to get the loan caught up due to financial hardship that I could pay the remaining payment the following week. After making the payments the lender still hired a 3rd party debt collector tow company to repossess the vehicle. I called the bank and informed them of our agreement and they said it is out of there hands and they would do nothing unless I paid the entire amount. Due to this unlawful repossession I was unable to attend work that day and had to take off the next day to pick up my belongings from the vehicle. This has caused much stress and anxiety. The lender and the repo company both violated NC law. North Carolina General Statutes Section 25-2A-207. North Carolina General Statutes Section 20-77 states that : Before a vehicle can be repossessed, the debtor must be provided with written notice of the intent to repossess, which includes information about the debtor 's right to cure the default and the amount necessary to do so. The debtor must be given at least 10 days to cure the default. I never received a notice prior. From the lender-santander or the repo company XXXX XXXX XXXX located in North Carolina at XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and the lender-Santander Consumer USA XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX This is an urgent matter and the vehicle may be sold within 10 days I would like to resolve this matter as quickly as possible.
