On XX/XX/XXXX I faxed a complaint to XXXX XXXX due to late payments reported on my credit report while I was on a COVID forbearance program, as my wife had contracted XXXX twice in XXXX and was hospitalized, causing a loss of income and increased medical expenses. I included copies of the mortgage statements that they had sent to me during this period of negative reporting, which clearly state on the statement that You are currently on a COVID-19 Forbearance Plan. See additional information related to COVID-19 Forbearance Notice on page 2. The same statements further state : " IMPORTANT COVID-19 FORBEARANCE NOTICE : You are currently on a COVID-19 Forbearance plan. Please note that the billing statement shows the Amount Due, which is the contractual amount needed to bring the loan current, however, you are not required to make any payments during the COVID-19 forbearance period. In addition, your account will not be assessed late charges, receive adverse credit reporting and there will be no foreclosure action during the COVID-19 forbearance period. Please refer to your COVID-19 Forbearance plan letter or visit your account online for more details. '' However, their response was that while the statements indicated the active forbearance there were other letters sent advising that the forbearance was expiring. However, I extended the covid forbearance and they don't have any documentation stating the forbearance expired or was extended, even though they continued it for a period thereafter. Furthermore, when I asked for reinstatement options they referred me to the State of Texas website which indicated that my income was too " high '' for any programs and I had to come up with twenty four months of payments in one lump sum to avoid foreclosure. I paid over {$29000.00} to keep my house after being on a government backed forbearance program. How did anyone expect to pay all the months that were deferred in one lump sum payment? Also, during the forbearance period XXXX would not accept partial payments. This was a terrible and frightening experience to have the threat of losing our house after dealing with Covid. I feel XXXX is not supportive of the governments efforts nor the situations that some of their borrowers faced on these unprecedented times. And I would also ask why the government programs could not help all Americans that were on these deferred programs. I have been unable to refinance this mortgage or obtain credit due to these marks. It has had an extremely detrimental effect on our lives.
