Below is a SECOND letter I sent to ALL 3 Credit Bureaus regarding a XXXX still being reported on my Credit Report. I filed for a XXXX back in XXXX and the plan was completed 5 yrs later as agreed. Now we are 7yrs since the payback plan, ( 5 yrs ). As of my latest request we are now 12 years since my filing date. XXXX plans once " filed '' are only suppose to be on a Credit Report for XXXX. That means my XXXX should have removed the reporting of " 120days late '' by XXXXXXXX XXXX back in XXXX. Not sure if this constitutes a law suit or not? To whom this concerns, This is my second request that you remove my 120 days late from my credit report I am writing this letter in hopes that you will remove the disparaging remark, ( XXXX XXXX 120days late ) on my Credit Report. I initially contacted XXXX XXXX requesting that they remove the 120 days late on my Credit Report on XX/XX/XXXX requesting to speak with the XXXX XXXX in reference to Account # ending in XXXX in the amount of {$85000.00}. After several phone transfers within XXXX XXXX I was connected to their XXXX Dept whom I spoke with XXXX, ( sp ) ( Female employee ). After she asked me some verification questions she was able to see the account ending in XXXX for {$85000.00}. I went on to explain my reason for calling, ( to please have XXXX XXXX remove the derogatory remark on all 3 Credit Bureaus that were reporting 120 days late since I had completed my XXXX plan as agreed and that its been 5yrs since I have completed the plan. She stated she would pass on my request and that I would receive a letter as to the decision of my request. I then received a letter from XXXX stating that they could not remove the derogatory remark and I would have to contact all 3 Credit Bureaus and request that they remove it. Here are some timelines regarding my XXXX filingOn XX/XX/XXXX I filed for XXXX protection. Then on XX/XX/XXXX the plan was confirmed. On XX/XX/XXXX the XXXX was discharged. My XXXX only included XXXX XXXX on a Junior lien account ending in **** in the amount of {$85000.00}. During my plan I had paid back in the amount of {$81000.00}. Leaving a write off of a little over {$3000.00}. I find it very difficult that Equifax, XXXX XXXX XXXX continue to punish me for the amount of {$3300.00}, ( this is the difference of the {$81000.00} paid back in my XXXX out of the original balance of {$85000.00} ). I had proven my credit worthiness before I filed for XXXX XXXX protection and continue to do so after my discharge. Its now been 12 YEARS since I filed for XXXX protection and 7 yrs since the discharge. So, in closing I am writing this letter in the hopes that you will find it in your heart to remove your derogatory remark which states in part 120 days late and end my continued punishment, preventing me from obtaining a Credit score worthy of the best offers in Financing as well as Auto Insurance amongst other credit related opportunities that I have earned the privilege & right to obtain.
