Consumer Narrative
On XX/XX/2023, I filed for a dispute on an auto loan account I have on my credit report. As of that same day, XX/XX/2023, that account was paid in full and I provided receipts showing that the account was paid in full. XXXX, the company investigating my dispute, finalizes my dispute today XX/XX/2023 and states that they updated the information but upon checking my report, they said for the month of XXXX, the account shows as charged off. Normally a final decision from the company that I have a credit line with does not finalize any decisions until the end of the month but they decided to say that its still delinquent and charged off when I paid the amount in full. I have proof of the receipts, confirmation codes, as well as bank account withdrawals from Exeter Finance that shows they took money out in a total amount of {$8100.00}. Specific days go as follows : - Friday, XX/XX/2023, a {$3000.00} payment was made to Exeter Finance as well as a {$2900.00} payment. In total, a {$5900.00} payment was made to Exeter Finance on XX/XX/2023. - Monday, XX/XX/2023, a payment of {$2200.00} was made to Exeter Finance. In total, with all payments made, it should add up to {$8100.00} which is the total amount Exeter Finance states I owed so as of XX/XX/2023, the account was paid in full and there should be no balance. I was also told that I should receive my title for the vehicle within 30-45 days which further states that the payments that were sent were finalized, accepted, and processed in their system to move on with the title process. XXXX reporting inaccurate information on my account and stating that the account is not paid in full when I provided them accurate information which comes straight from the Loan company in which I had a credit line with is most definitely an offense in regards to my consumer rights. According to 15 U.S. Code 1681A Sub Section 2 ( Exclusions ), the term consumer report DOES NOT include ANY REPORT containing information solely as to TRANSACTIONS or EXPERIENCES between the CONSUMER and the PERSON MAKING THE REPORT. Meaning, a transaction or experience with Exeter Finance such as a " Late Payment '' that could cause the account to become closed or charged off. That is considered an experience that Exeter Finance had with myself which is against my consumer rights for this information to be reported. Nothing under the Fair Credit Reporting Act requires ANY financial institution to furnish negative information to a consumer reporting agency. The damages this has caused has made other financial institutions such as XXXX XXXX, XXXX, XXXX, etc., deny me of credit because XXXX continues to report false information on my account which in term has decreased my credit even further.
