Consumer Narrative

Back in XX/XX/XXXX I worked for a company ( XXXX ) based out of XXXXXXXX XXXX This was a remote job from home. I had worked for this company prior in XX/XX/XXXX on the same project remotely as well. I had given them my checking acct info for my checks to be direct deposited never had a problem prior in XXXX. When I worked for them again in XXXX I gave HR the same information for direct deposit as I did in XXXX. My first paycheck was deposited with no problem. The second direct deposit was not showing in my account. I called my bank they told me that it was an error on my employers side, and to contact them. So I did. The HR receptionist pulled mu info up and told me that it shows in their system that my bank had accepted the deposit, and so it is an error on my banks end. Once again I called my bank. They claimed that they could not find the deposit anywhere. I even gave my bank the check number and code if you will from my HR dept so my bank could track it in their system. Still my bank continued to tell me that it was an error on my employers end, and my bank told me that my employer XXXX have deposited my check into another acct. I ended up going into my bank and speaking with the branch manager regarding this issue I had my boyfriend with me as my witness because this was insane. The manager had no answers for me at all. I sat in the bank lobby for an hour and 20 minutes while he went back and forth into their electronic area who handle the deposits which is South of the bank tellers behind the counter. I was told told once again by this branch manager that it was an error on my employers end. Come to find out the bank had deposited my check into another person 's account they claimed that had the same information as mine. And by the time I was informed I had already had my employer cancel that check and mailed me via air mail my check to my residence. The next incident was my employer deosted my check into my account and 7 days later after my bank had cleared the deposit and funds were no longer available. My employer reversed my deposit. My bank allowed this reversal knowing that I did not have the funds in my account to cover this reversal making me XXXX without my consent or contacting me to notify me. I receive calls and emails 2 weeks after the fact that my account was in the negative again. My employer reversed over 100 employees payroll checks from their accts claiming their payroll company over paid some employees. My check was issued in the same amount as the one previously deposited. An email was sent out to HR and all team managers were ordered to take back our checks however they have to or whatever it takes. I have that email. Now I am being sued by my bank for the fault of my employers payroll company plus attorneys fees and court costs. I have had numerous issues with this bank and allowing my account to go in the negative. They have credited my account before over {$400.00} for allowing unauthorized entities to withdraw from my account although the funds are not there t9 cover the amount taken. The bank is Mountain America
