Dear Consumer Financial Protection Bureau, I, XXXX XXXX, am writing to file a complaint against XXXX ( formerly, XXXX ) for violating the Fair Credit Reporting Act ( FCRA ) and the Fair Credit Billing Act ( FCBA ) in relation to the inaccurate reporting of my car loan payments. I entered into a written agreement with XXXX for a payment deferment on my car loan. However, despite this agreement, XXXX has reported my loan payments as late to credit reporting agencies, causing damage to my credit score and hindering my ability to utilize the banking system fairly. In accordance with the FCRA, 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ) and ( B ), XXXX is required to report my loan payment history with accuracy and fairness, and to take appropriate steps to resolve any disputes regarding the completeness or accuracy of the information provided. Additionally, the FCBA, 15 U.S.C. 1666 ( a ), requires that credit card issuers and other creditors accurately report account information to credit reporting agencies. Furthermore, XXXX is in violation of the FCRA, 15 U.S.C. 1681s-2 ( b ) ( 1 ) & ( 2 ) and FCBA, 15 U.S.C. 1666i, which indicate that upon a written and signed deferment agreement between the lender and borrower, the payment history is supposed to be current without any late payments. I respectfully request that the Consumer Financial Protection Bureau take immediate action to correct the inaccuracies on my credit report, and that XXXX be held accountable for their failure to report my loan payments in accordance with the law. Specifically, I request that my credit report be updated to reflect the " current status- never late '' and that any late payment history be deleted from my credit report based on the deferment agreement.
