On or about XX/XX/XXXX, I filed a complaint with the CFPB against Experian regarding incorrect names and addresses on my credit report with Experian. Despite uploading my ID Theft Report filed with the FTC and a police report filed with the XXXX XXXX crimes unit ( XXXX ), Experian REFUSED to delete the fraudulent names and addresses from my credit report. Prior to the CFPB complaint, I sent not less than 4 certified mail letters to Experian requesting the removal of these fraudulent names and addresses from my credit report to which they never responded. I also made approximately 4 different phone calls to Experian 's fraud department, and submitted several online disputes, which continue to be ignored by Experian. As federally protected consumer, Experian willfully and negligently continues to violate my rights under the Privacy Act of 1974, 5 USC 552a, 15 USC 6801, and 15 USC 1681a which states in part that ( a ) Accuracy and fairness of credit reporting The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system ; ( 3 ) Consumer reporting agencies have ASSUMED a vital role in assembling and evaluating consumer credit and other information on consumers ; AND, ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a RESPECT for the consumers right to privacy. Since Experian claims that my complaint was " not specific '', SPECIFICALLY, the following NAME ID # XXXX used by Experian are INCORRECT/FRAUDULENT/INACCURATE XXXX Name ID # XXXX The following address ID # XXXX used by Experian are INCORRECT/FRAUDULENT/INACCURATE/NON-MAILABLE : XXXX Address ID # XXXX XXXX Address ID # XXXX XXXX Address ID # XXXX XXXX Address ID # XXXX XXXX Address ID # XXXX My ONLY address is Address ID # XXXX. Experian is obligated by the FCRA to report accurate consumer information. I, the consumer, have advised Experian to remove and delete the inaccurate names and addresses from my consumer report and that the information was a result of fraud. Experian had 4 DAYS to remove and delete the information by LAW. A FTC fraud report was filed, and a police report was filed YET Experian FAILED to comply with the LAW. Experian has 15 days to provide me with the name of the person ( s ) spoken to, documentation used, and signed application ( s ) with my wet ink signature ( s ). If Experian does not have documentation to show that this information is in fact verified, then it is to be removed and deleted ASAP. To be specific, I am NOT asking for an e-oscar report or information contained in the e-oscar report. Should Experian not remove the information specifically requested in this complaint, I will move forward with filing a XXXX and form XXXX treasury omb to audit my consumer file as Experian files securitization reports with the SEC using consumer data.
