I AM A FEDERALY PROTECTED CONSUMER AND I KNOW I HAVE FEDERAL RIGHTS. XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX Pursuant to the Fair Credit Billing Act, A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. This account is a billing error. This is not a refusal to pay but a notice that this alleged debt is disputed. I respectfully request XXXX provide me with documentary evidence validating this alleged debt. If no such evidence of indebtedness exists, and the only indebtedness is by AGREEMENT, XXXX can not lawfully furnish these inaccurate late payments to the credit reporting agencies. The United States is bankrupt. If this alleged debt is valid, what authority does XXXX have to collect this debt in the United States? If this alleged debt can not be validated and turns out to be an extension of credit, that would make the negative information provision in any agreement between us VOID AND UNENFORCEABLE. The continued reporting of these inaccurate late payments would constitute a breach of fiduciary duty by collecting this extension of credit by unlawful extortionate means. And under the CARES ACT which Congress enacted in XXXX which is still LAW AND IN EFFECT STATES THAT LATE PAYMENTS SHOULD NOT BE PUT ON CREDIT REPORTS WHEN CONSUMER INFORMS INSTITUTIONS THE NEED FOR ACCOMODATION DUE TO THE GLOBAL PANDEMIC CRISIS WHICH I I HAVE BEEN EFFECTED AND I FIRST REACHED OUT AND ASKED FOR ACCOMODATION IN XX/XX/XXXX WHICH XXXX DENIED ME, AND CONTINUED TO REPORT LATE PAYMENTS ON MY CREDIT REPORTS WITH NO ACCOMODATION NO PROTECTION PER THE CARES ACT. I SHOULD HAVE BEEN PROTECTED AND RECIEVED ACCOMODATIONS PER THE CARES ACT due to my situation. And Since there is no law under the Fair Credit Reporting Act requiring this financial institution to report negative information to consumer reporting agencies, XXXX APPEARS to knowingly be reporting inaccurate information to the consumer reporting agencies. Reporting information with reasonable cause to believe is inaccurate violates the Fair Credit Reporting Act and the CFPB has been investigating and taking action against institutions and companies. Like recently CFPB XXXX XXXXXXXX XXXX XXXX who did not implement protection under the CARES ACT on behalf of the consumers. XXXX companys policy does not supersede Federal Law. I am demanding that all late payments are UPDATED to PAID AS AGREED and a DELETION of each late payment be submitted to all credit reporting agencies immediately to prevent my consumer credit reputation from further harm and stopping me from extending credit in commerce which is my right due to XXXXXXXX XXXX not complying with the CARES ACT which is still LAWFUL I understand that Under the Consumer Financial Protection Act, the CFPB has the authority to take action against institutions violating consumer financial protection laws, including engaging in unfair, deceptive, or abusive acts or practices.
