According to 15 U.S. Code 1681 ( a ) ( 4 ) and ( b ) - Congressional findings and statement of purpose ( a ) ACCURACY AND FAIRNESS OF CREDIT REPORTING The Congress makes the following findings : ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( b ) REASONABLE PROCEDURES It is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter. Consumer reporting agencies can only hold Files and Consumer Reports on Consumers as defined in 15 U.S. Code 1681a ( c ). I am not a Consumer or a Person as defined in 15 U.S. Code 1681a ( b ) and ( c ) and I am not an individual as defined in the Privacy Act of 1974 ( 5 U.S. Code 552a ( a ) ( 2 ) ). This is evidenced by the attached Revocation of Election and United States Postal Service Electronic Return Receipt, received by XXXX XXXX acting Commissioner of the Internal Revenue Service on XX/XX/XXXX. The three national consumer reporting agencies XXXX, XXXX XXXX, and Equifax and all other consumer reporting agencies must delete and dispose of all information in any file pertaining to the consumer report of XXXX XXXX XXXX. This is to ensure that consumer reporting agencies are following accurate and fair credit reporting procedures in accordance with the Congressional findings and statement of purpose of the Fair Credit Reporting Act. If XXXX, XXXX XXXX, and Equifax and all other consumer reporting agencies continue to hold a file as defined in 15 U.S. Code 1681a ( g ) including a consumer report as defined in 15 U.S. Code 1681a ( d ) ( 1 ) of information pertaining to XXXX XXXX XXXX this would be evidence of the said consumer reporting agencies depriving me of my substantive right to privacy in which my private information has been publicly placed in a false light and caused harm to my reputation causing me psychological, financial, and reputational harm which is a direct violation of the Fair Credit Reporting Act. XXXX, XXXX XXXX, and Equifax and all other consumer reporting agencies are required by Law to comply with the requirements of the Fair Credit Reporting Act and are subject to 15 U.S. Code 1681o - Civil liability for negligent noncompliance. According to 15 U.S. Code 1681o ( a ) ( 1 ) ( 2 ) ( a ) In general Any person who is negligent in failing to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) any actual damages sustained by the consumer as a result of the failure; and ( 2 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. Take notice that this Consumer Financial Protection Bureau complaint and your responses will be used as records/ evidence of your negligent noncompliance to the Fair Credit Reporting Act among other Laws of the United States.
