I applied for a conventional loan with Caliber Home Loans. Then the loan officer advised me I do not qualify for a conventional loan since i had a foreclosure on my record. She tried to force me in accepting an FHA Loan. I spoke to the loan officer to let her know the payments were beyond my budget and she did not want to deny the loan. Since, I did not trust her explanation of why she wasn't denying my loan, I emailed her requesting her to deny my loan. She responded with an email with other mortgage payment options and not acknowledging my request to deny my loan. I emailed her supervisor and he responded by calling me. I explained to him what has transpired and he said he was going to look at my file and get back to me the next day. He has not gotten back to me as of XX/XX/22. I sent another email XX/XX/22 directly to my realtor and the loan officer requesting to cancel my contract and refund my deposit. I specifically used the verbiage " I would like to exercise my contractual rights '' and " please issue a release and cancellation immediately '' under the contract 's financing section : If Buyer is unable to obtain loan approval within the loan approval period, or can not timely meet the terms of loan approval, all after the exercise of good faith and diligent effort, buyer may terminate this contract ... ... ..... I received a " Release and Cancellation of Contract for sale '' on XX/XX/22 evening. It was signed immediately and Im awaiting seller 's signature to be finalized.
