On XX/XX/XXXX I took out an auto loan from Wells Fargo Auto Finance for {$19000.00}. I was reluctant in doing so at the time, because other lenders were willing but I was pressured by calls from Wells Fargo to take their loan. On XX/XX/XXXX, after research, I saw that Wells Fargo Frauded me on this auto loan and was collecting interest from me on it. On XX/XX/XXXX, I sent a notice for dispute to Wells Fargo along with a notarized affidavit for debt Validation and Verification. The items that I requested responses to were : 1. That I have the requisite knowledge of the facts regarding Wells Fargo Auto Account XXXX XXXX including, account ledgers and bookkeeping entries ; 2. That Wells Fargo Auto does not follow Generally Accepted Accounting Principles ( GAAP ) or the Federal Reserve Banks policies and procedures, and did not create credits from the Account holders signed receipts, promises to pay, notes, or other instruments ; 3. That Wells Fargo Auto used its own money, money equivalent, credit or capital, or that of other depositors, as adequate consideration to purchase the loan agreement and notes from the Account holders ; 4. That Wells Fargo Auto did not accept, receive or deposit any money, money equivalent, note, credit or capital from the Account holders to fund a note, check or similar instrument that was used to finance/fund the charges on the alleged account ; 5. That Wells Fargo Auto incurred financial losses and has been damaged in the amount of $ {$11000.00}, and is attempting to collect a bona fide debt arising from services provided and/or goods sold to the Account holders ; 6. When accounts are 90 days or more overdue, Wells Fargo Auto does not receive a payoff of the amount due from insurance, whose premiums were unknowingly funded by the so-called borrower. 7. That all material facts and terms and conditions regarding the alleged account, have been disclosed to the Account holders in the agreement and promissory note ; 8. That Wells Fargo Auto is the holder in due course of all notes and that the notes were taken for value, in good faith, and without any notice of claims or defenses, and that any transfer of the account was made with the full knowledge and consent of all the parties ; and 9. That I have personal knowledge that the agreement and promissory notes were not altered or forged in any way. Wells Fargo neglected to answer the questions to validate this debt but did mail me and invoice on XX/XX/XXXX. High levels of stress set in within me when my affidavit wasn't responded to. I then sent out a 2nd notice - Opportunity to cure on XX/XX/XXXX, which was received by XXXX XXXX of Wells Fargo on XX/XX/XXXX. Still no response was given back to me in regards to my affidavit. Instead Wells Fargo replied with another invoice on XX/XX/XXXX, clearly avoiding my points in the validation and verification of debt affidavit in response, I mailed to them a notice of Non compliance on XX/XX/XXXX, which was received on XX/XX/XXXX by XXXX XXXX of Wells Fargo. On two separate letters dated XX/XX/XXXX, Wells Fargo responded with a payment deferment ( which I never requested ) and also a notice to repossess. Still no reply to my affidavit. I then replied to their affidavit on XX/XX/XXXX with my intentions of next steps, which was received by XXXX XXXX of Wells Fargo on XX/XX/XXXX. Still my affidavit is not being respected or replied to. This process has limited me to due to XXXX and stress where I have become non efficient at my place of work and equally non efficient or effective as a loving partner to my fianc. I ask for your help.
