I sent a certified letter addressed to Experian dated XX/XX/22 and received by Experian on XX/XX/22 ( Attached ). In the letter I requested that Experian provide me the " NAME AND ADDRESS '' of the company it contacted to validate the " COMPLETENESS and ACCURACY '' of a reported bankruptcy record on my consumer file. In its response on XX/XX/22 in report # XXXX Experian stated that " The company that reported the information has certified to Experian that the information is accurate. This item was not changed as a result of our processing of your dispute. Please review your report for the details. '' In my letter I clearly did not request for a verification, but a " VALIDATION '' based on the report it received from XXXX XXXX ( Data Furnisher ). In my dispute I provided Experian with a report and statement from XXXX XXXX which clearly shows " NO BANKRUPTCY '' in their database. I have attached this full consumer report from XXXX XXXX to this complaint. In addition, I have attached a letter from the Bankruptcy court certifying that they did not report any filings to Experian. Experian is clearly using " UNVERIFIED '' " INACCURATE '' and " INCOMPLETE '' information it has allegedly obtained from XXXX ( a public database ). I have disputed the information obtained from XXXX and therefore according FCRA 15 U.S. Code 1681i, Experian must complete a full investigation. In Cushman v TransUnion, Stevenson v. TRW ( Experian ), and Richardson v. Fleet, Equifax the court ruled that CRA 's can not merely " PARROT '' Information and that it must conduct an Independent REASONABLE investigation. Based on the facts provided. I am demanding the removal of this bankruptcy record from my credit file due to Experian 's failure to conduct a REASONABLE investigation by contacted the court and or data furnisher for the " Completeness and Accuracy '' of this record. Experian has refused to provide me with the " Name and Address ' '' of the company it contacted as required by FCRA law. Experian continues to use " TEMPLATE '' responses to avoid having to provide " FACTUAL '' proof of evidence. I am not requesting a " RE-INVESTIGATION '' I am demanding the removal of this record solely on the evidence presented. Experian HAS NOT communicated by US Mail in an attempt to AVOID being held liable for its lies.
