Consumer Narrative

Equifax has taken adverse action against me, with forethought and malice, by furnishing inaccurate and knowingly false late payments to my consumer report without my lawful authority. This adverse action as defined under 12 CFR 1002.2 ( c ) ( 1 ) ( i ), which has the same definition as 15 U.S. Code 1691 ( d ) ( 6 ), has negatively affected my ability to extend credit and operate in commerce. Congress makes it clear that causing a restraint of trade or conspiring to cause a restraint of trade, pursuant to 15 U.S. Code 1, is declared to be illegal to and carries both civil and criminal penalties. My right to privacy and my right to know where and how to direct the disclosure of my nonpublic information in accordance with 15 U.S. Code 6801 ( a ) of the Gramm-Leach Bliley Financial Protection Act, has been violated. I am aware that not excluding transactions between, I, the consumer, and the creditor is a violation of 15 U.S. Code 1681a ( 2 ) ( A ) ( i ) which states report containing information solely as to transactions or experiences between the consumer and the person making the report. The consumer reporting agencies were not exercising their grave responsibility in respect to impartiality when furnishing this false and misleading information to my consumer report. Reasonable procedures were not taken to insure the accuracy of the information given by XXXX before furnishing it. This shows that the consumer reporting agencies have shown bias towards me because I never gave my lawful authority for any consumer reporting agency, specifically Equifax to furnish any late payments to my consumer report. It is my belief that due to XXXX business relationship with Equifax they parrot any information given to them as a means of coercing consumers to pay extra fees for debts that they allegedly owe. Furthermore, pursuant to 15 USC 1666 ( B ) a creditor, in this case XXXX, may not treat a payment on an account under an open-end consumer credit plan as late for any purpose. XXXX also ignores that fact that it violated my consumer rights by not proving opportunity to opt of data sharing with any third parties and never had my consent to do so, specifically not Equifax. Equifax also ignores how the account could be list as current and then reported next as 60 days late, which is a clear billing error and another violation. A late payment is a transactional history, My history with the creditors listed above and CONGRESS has clearly stated that history should not be included on my consumer report. If this was a factual transaction ( which Equifax would not know because you were not a party or present when a transaction is commenced ) it would in fact be a transaction that solely took place between me and the person ( the alleged creditor ) who allegedly furnished the information to Equifax. I as a consumer would need to give Equifax PERMISSION to furnish information on my behalf. To date, I have not granted Equifax or XXXX such authority. Equifax has caused severe stress and anxiety due to the abusive and unfair practices. I am also aware that all negative remarks found on my credit report is a violation of the FCRA and FDCPA when you can not furnish the validity of the remarks contained on the consumer report. Pursuant to 15 USC 1681 ( a ) ( 4 ) as a consumer I have a right to privacy and accuracy. There is a need to insure that Equifax exercises its grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. The burden proof is not on me, but you when these errors are identified and your failure to adhere to the law have been significantly damaging. Therefore, Pursuant to 15 USC 1681 ( a ) ( b ) you did not meet the needs of the commerce because the reporting of this inaccurate information has not been fair and equitable to me. This information is not accurate, nor is it relevant to me. Nor was this false information proper utilized in a manner that is or was equitable to me. This transaction, even if they took place shouldve been confidential so XXXX and Equifax in fact betrayed my confidence.
