Firstly, The United States Bankruptcy Courts state on their website that they DO NOT verify, nor do they report bankruptcy records to ANY consumer reporting agency. I have also personally researched XXXX for case identification number XXXX provided and found no validity of you claim. As of XX/XX/2022, after investigation confirmation ( # XXXX ) Equifax confirmed that the bankruptcy was deleted ( attached ). In the instructions provided in said document, Equifax states the following : " If items states " Deleted '' we have removed it from your credit report and taken steps so it does not reappear. '' But in an email received on XX/XX/2022 ( which is passed any 30 day investigation timeline ) Equifax sent a reinvestigation confirmation ( # XXXX ) dated XXXX XXXX, 2022 stating that the above mentioned item was verified by XXXX XXXX on XX/XX/2022 which breeds a huge discrepancy on my consumer report. The personal information on XXXX does not match the personal information provided in any of the dispute investigations mailed to me by Equifax ( also attached ), and is not sufficient to verify my identity accurately. In 15 U.S. Code 1681e ( b ) Compliance procedures, The Congress states the following : ( b ) Accuracy of report Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. According to 602. Congressional findings and statement of purpose [ 15 U.S.C. 1681 ] ( a ) Accuracy and fairness of credit reporting. The Congress makes the following findings : ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. A report of a bankruptcy is an infringement of my right to privacy and such reporting is a direct violation to the Fair Credit Reporting Act 15 U.S.C. 1681 ( a ) ( 4 ) a consumers right to privacy. Congress also states that I, XXXX XXXX, must give written permission to Equifax, nor have I given XXXX XXXX to access or distribute for profit any of my public information : 604. Permissible purposes of consumer reports [ 15 U.S.C. 1681b ] ( a ) In general. Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates.
