On XX/XX/XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX and Equiant Financial Services Inc timeshare developers attempted to collect a debt using egregious conduct referring to debtor 's race forcing payment using prior court dismissals. As a result, compliant/debtor sought federal court action ( Edwards et al v. Flagship et al., 1:22-cv-05386-KMW-AMD ) in violation of 42 U.S.C. Section 1983 Civil Rights violation and under the Fair Debt Collection Practices Act, 15 U.S.C. Section 1692, which prohibit debt collectors from engaging in abusive, deceptive and unfair practices. In addition, debtor filed in XXXX XXXX ( Edwards et al v. Flagship et al, ATL L-002502 22 ) against the above mentioned companies in violation of New Jersey Consumer Fraud Act, N.J.S.A. 56:8-1, which prohibits activities of " unconscionable commercial practice '' " deception '' " false promise '' and " misrepresentation. '' When called, the timeshare was never available for use under the timeshare agreement of odd year usage nor during alleged peak seasons. But, when called back minutes later there was availability at owners discounted rates. In XXXX, on top of the monthly payments there additional per night visit cost of {$45.00} dollars and one night {$100.00} dollars exercising a " double-dipping cost policy as a matter of practice and custom with deliberate indifference.
