On XX/XX/XXXX, my identity was stolen and used in connection with the purchase of goods primarily for my personal use. I submitted a credit application for an extension of credit to XXXX XXXX of which XXXX XXXX then used my nonpublic personal information from my credit application such as my ( social security credit card ) pursuant to 15 USC 1602 ( 1 ) and submitted false loan applications in my name to XXXX XXXX XXXX XXXX XXXX and XXXX XXXX received advanced loans in my name which is identity theft. Thus, resulting in I the consumer paying back pure profit and depreciation cost for XXXX. XXXX XXXX nor XXXX not once ever received my direct consent to disclose my NPI with nonaffiliated XXXX parties nor did XXXX XXXX and XXXX disclose with I the protected consumer my right to opt out to my XXXX being shared at any time of the duration of the credit transaction pursuant to 15 USC 6802 ( b ) My identity was stolen an frequently obtained and used on a loan application when I didn't apply for a loan, I applied for an extension of consumer credit. This is a violation of 15 USC 6821a ( 1 ) - ( 3 ). I discovered this fraud on or around XXXX of XXXX and begun disputing the debt with the creditor pursuant to federal law 15 USC 1692g. These claims are currently pending active litigation. In connection with these claims, I have also disputed this alleged debt with the XXXX major CRA 's ( XXXX, Transunion, & XXXX ) of which XXXX XXXX XXXX XXXX continues to report adverse and inaccurate information to the CRA 's regarding this alleged debt under the tradeline XXXX XXXX XXXX, doing so without my direct written consent and instruction pursuant to 15 USC 1681b. XXXX is in violation 15 USC 1681s-2a ( 1 ) ( A ) - ( B ) ( ii ) since information furnished to a consumers consumer report is voluntary and there is no law mandating or requiring data furnishers to furnish information and XXXX has never received written or oral communication from I, the consumer. The supposed investigative results of the disputed alleged items on my credit file conducted by the XXXX Major CRA 's are not in compliance with the provisions of the Fair Credit Reporting Act. Thus, I am seeking monetary relief in accordance with 15 USC 1681n ( a ) ( 1 ) ( B ). The following inaccurate items remain on my credit file from the tradeline XXXX XXXX XXXX. In compliance with my written instruction to remove the delinquent inquires on my credit file, XXXX and Transunion have since removed the inquiries from my credit file except, the following inquiry from " XXXX XXXX '' abruptly remains on my file. XXXX has not removed any of the " Hard '' delinquent inquires reflecting on my credit file as I instructed them to in my " Letter to correct inaccurate information ''. XXXX, Transunion and XXXX have all changed the current status of the item reported under the tradeline XXXX XXXX XXXX as " closed '' " charged off as bad debt '' instead of removing the item completely in compliance with federal law. As the original creditor and grantor, I do not validate the alleged debt, nor do I consent to the inaccurate info regarding the alleged debt be reported to the CRA 's. XXXX d/b/a XXXX XXXX XXXX and the XXXX Major CRA 's never received written instruction from I the consumer to report the adverse items on my credit file. Thus, in accordance with the provisions of the FCRA and written instruction from I, the consumer, the alleged item should have been removed. The accuracy of the information contained in my credit file is determined by me, the consumer and natural person. It can not be determined by any consumer reporting agency, debt collector, creditor or any other data furnisher. In support of my claims, I have attached appropriate documentation and an invoice regarding my specified remedy.
