I am writing on behalf of my client, the current homeowner of XXXX XXXX XXXX, XXXX, MA. My client is currently facing an improper foreclosure based on a " zombie '' second mortgage serviced by Planet Home Lending , LLC. He had not heard about this mortgage since he modified his first mortgage in XXXX through HAMP, and had been told then that the second lien was discharged. However, in XX/XX/XXXX, he began receiving statements and letters stating he owed more than $ XXXX, made up of ~ $ XXXX in principal and almost ~ $ XXXX in accrued interest. Because he had not received any correspondence regarding the second mortgage in 5 years and the amount claimed to be owed was significantly higher than the original principal balance on the loan, he believed that he was being scammed. It was not until the foreclosure auction was scheduled that the homeowner reached out to legal counsel, who was able to assist in postponing the auction. Since the postponement of the auction, counsel for the homeowner has brought several errors of Planet Home Lending to their attention. Please see enclosed XXXX demand letter. Planet Home Lending 's counsel has responded, denying the homeowners claims and refusing to accept the homeowner 's settlement offer ( $ XXXX in total for complete discharge of loan ).
