On XX/XX/2022, I submitted a reinvestigation request to Experian requesting that they conduct an reinvestigation on 5 accounts I am disputing with XXXX XXXX XXXX XXXX via certified mail : XXXX. See Exhibit 1 On XX/XX/2022, I also submitted a debt validation dispute letter to XXXX XXXX XXXX XXXX via certified mail : XXXX pursuant to rights under the Fair Debt Collection Practices Act. See Exhibit 2 Within a weeks worth of time Experian completed its reinvestigation on XX/XX/2022 claiming to have verified the accounts with XXXX XXXX XXXX XXXX See Exhibit 3 Experian did not conduct a thorough and reasonable reinvestigation upon my request which is a violation of my consumer rights under the Fair Credit Reporting Act. This proves that Experian does not have reasonable procedures in place to ensure that the maximum possible accuracy was reporting on my credit file. XXXX XXXX XXXX XXXX failed to respond within 30 days of receiving my debt dispute letter which would have been XX/XX/2022. On XX/XX/2022, I mailed Experian a factual dispute letter clearly communicating that I was in disagreement with its reinvestigation results because XXXX XXXX XXXXXXXX XXXX never responded to my dispute letter and failed to validate the account. See Exhibit 4. I also informed Experian that the accounts were not reporting 100 % accurate, that the first date of delinquency was not reporting on my Experian report but it was reporting on my XXXX report and demanded that they be deleted and provided proof of the inaccuracies. On XX/XX/2022, I mailed XXXXXXXX XXXX XXXXXXXX XXXX a notice informing them of their failure to validate the alleged debt and that they were in violation of my rights under the FDCPA. See Exhibit 5 XXXX XXXX XXXX XXXX still failed to provide proof to validate the alleged debt. XXXX XXXX XXXX XXXX never provided a Letter of Sales agreement, an assignment agreement from the original creditor and never provided a copy of the original contract with my signature on it for none of the disputed accounts. On XX/XX/2022, I reported the furnisher and the disputed accounts to the Federal Trade Commission via a Identity Theft Report report number XXXX. I then got my official identity theft report notarized on XX/XX/2022. On XX/XX/2022, I submitted an Identity theft dispute to Experian. I provided Experian with proof that I previously been in contact with XXXX XXXX XXXX XXXX, proof of my identity, proof of my social security number, proof of address along with a copy of my notarized FTC Identity theft report. See Exhibit 6 On XX/XX/2022 sent me dispute results stating " PLEASE REFER TO YOUR CREDIT REPORT. '' See Exhibit 7. Experian never conducted a identity theft investigation per my dispute request with supporting documentation violating my FCRA rights under 15 U.S.C. section 1681c-2 ( a ). Then on XX/XX/2022, Experian sent me results two weeks later stating " IF ACCOUNT WAS OPENED AS A RESULT OF IDENTITY THEFT, THE CREDIT GRANTOR MAY NOT KNOW HOW TO CONTACT YOU TO DISCUSS THIS MATTER. THE CREDIT GRANTOR REQUESTS THAT YOU CONTACT THEM DIRECTLY .... '' See Exhibit 8. Experian failed to conducted a identity theft investigation per my dispute request violating my FCRA rights under 15 U.S.C. section 1681c-2 ( a ) This clearly shows that Experian does not have reasonable procedures in place to ensure the maximum possible accuracy is reporting on my credit report. Experian was given proof that XXXX XXXX XXXXXXXX XXXX and I have already been in contact but somehow concluded that XXXX XXXX XXXXXXXX XXXX may not know how to contact me. Experian has been in violation of my FCRA consumer rights for the previous three months. Experian has knowingly violated 15 U.S.C. section 1681e ( b ) and 15 U.S.C. section 1681c-2 ( a ).
