On XX/XX/2021, My husband ( XXXX XXXX ) purchased a home for XXXX located at XXXX XXXX XXXX, XXXX Florida. In XX/XX/2021, we received an email from XXXX XXXX ( the attorney who handled the closing ) stating we owed her XXXX. I asked XXXX XXXX for a full accounting of my escrow account. XXXX XXXX did not provide any proof the escrow account had any missing money and proceeded to sue me for the XXXX. I retained a lawyer in the suit and began research on my case. My attorney XXXX XXXX initially believed I should settle my case with XXXX XXXX. I provided XXXX XXXX with my research and explained we had RESPA, TILA, and TRID violations. XXXX XXXX then conducted his own research and concluded that several mistakes were made at closing that contributed to the errors. One of which was the Lender Veterans United did not follow the 3-day rule with my mandatory disclosures. My closing was on the same day as the disclosure. My attorney and I added Veterans United as a third party to the lawsuit. Veterans United failed to respond to our complaint and a clerk 's judgment was issued against them. The issue at hand is that veterans united did not follow the rules and issued a buyer 's disclosure with an incorrect purchase price. XXXX XXXX did not find the error at closing and did not balance the escrow account after the transaction, and in the following months. It took XXXX XXXX 6 months to notice the account was missing funds. However, at this point, it is just an allegation at this point because XXXX XXXX has not provided any financial records to substantiate her claims. My husband and I are both Veterans and we used our VA benefits to purchase this home with XXXX down, I paid XXXX as earnest money that should have been returned to me in full at closing. Due to the errors made by Veterans united and XXXX XXXX, we did not get refunded our XXXX at closing, and have attorneys fees associated with defending ourselves from their errors. We believe Veterans United must fix this problem. We believe XXXX XXXX and Veterans united are both time-barred from collecting the XXXX. My husband and I are concerned that Veterans United and XXXX XXXX will drag out the court proceedings in order to bully us into a settlement. XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and Veterans United is a big corporation. As such we request the CFPB to assist us. A homeowner should not be on the hook for errors caused and created by the mortgage lender six months after the purchase of a home. Respectfully, XXXX XXXX, XXXX
