NISSAN MOTOR COMPANY / NMAC ACCOUNT : XXXX XXXX XXXX XXXX XXXX, Tx XXXX I am a natural person, XXXX XXXX and am writing this letter on my own behalf. When I entered into this consumer transaction, with NMAC company account number XXXX that NMAC / NISSAN was and is in violation of 15 US code 1601, Ch. 41. Congressional findings and declaration of purpose. My understanding is that there must be an informed decision for there to be an agreement, and that did not happen between us. The first fact is that I made an uninformed decision when I entered into this consumer transaction. Congress says in part ( a ) that there must be an informed use of credit, therefore this is a violation, as I made an uninformed decision. Next, in part ( g ) congress says the the person to whom the debt is arising from the consumer credit transaction is initially payable on the face of the evidence of indebtedness, or, if there is no evidence then by agreement. You are in violation because there is no evidence of indebtedness, only an agreement, which is null and void because I made an uninformed decision. I also have requested to see proof that you suffered a loss or injury from the transaction. You have denied me that proof and a copy of the 1099C you should have filed after the charge off. I am concerned there may be tax fraud in addition to consumer protection violations. I have learned that the IRS defines charge offs as income and income isnt supposed to be reported on the consumer report. However, you have damaged my reputation by providing this to the credit reporting agencies for several years. Finally, in part ( K ), Adequate Notice, congress says there must be a printed notice clearly and conspicuously printed so the consumer is reasonably expected to understand. A computer generated notice of legal jargon was not understood by me, it was not clear and conspicuous and this is in violation.
