On XXXX I deposited a XXXX XXXX XXXX tax refund check for {$3300.00} via remote deposit capture through the Capital One consumer app. I was notified that there would be a hold on the deposit until XX/XX/12. I called the bank to inform them that the check is issued by a State Government entity and they requested I call back the following day to discuss the hold. Capital One indicated that there were no issues in my account. I have a regular history of significant bi-weekly deposits for payroll into this account and I had {$10000.00} held in savings account with the Bank on deposit so they also had recourse in the event that the XXXX XXXX XXXX did not have funds to clear the check. I called back and the bank refused to lift the hold. Because the check is a government check submitted electronically, I argued that it is subject to Check 21 and Reg CC and funds should have been made available the follow day according to regulations. The bank refused. ( I will not be holding any funds in savings deposit at this institution going forward because they do not follow regulatory requirements ).
