To CEO/person of highest Authorities, On XXXX XXXX at around XXXX I, XXXX XXXX, XXXX natural person & consumer ) went to Mercedes-Benz in XXXX XXXX Ohio in desperate need to get a car. I picked out the car that Ive been wanting for a very long time. I was very excited and hope that I would walk out the dealership with my brand new car however I was unable to do that due to the creditors and dealerships bad business practices. I filled out an application for a loan, before running my credit I told them that I wanted to do no down payment and that my credit wasnt good. They decided to run my credit anyways hurting my credit score. Upon application I gave them my Social Security number and my signature. Also upon my application they did not disclose any information or documents that they were supposed to disclose according to the law. I proceeded to ask them was there a finance charge they told me yes, some banks require a finance charge and some dont, Mercedes-Benz Requires a finance charge. I then proceeded to ask them are they in compliance with Truth in lending. They responded yes to that as well. Knowing that they were in compliance with the truth in lending act ( or so they said ) I was so excited and went ahead and test drove my chosen vehicle. However when I got back to the dealership they told me that my application has been approved with a {$40000.00} down payment. I asked them how is it possible that I can be denied my own extension of credit and/or how is it possible that I am required to put a down payment on my own extension of credit they were confused as to what I was talking about I then explain that I am aware of all rights that I have as a natural person and consumer. I explain to them the loss and the violations that they have violated with their bad business practices. I they acted as if I didnt know what I was talking about and had me talk to several different people. They told me that they could not discuss any laws and to consult a power of attorney. They then acted as if they had their own power of attorney which turned out to be just a supervisor/manager NOT A ATTORNEY. I asked him if he was an attorney he proceeded to lie to me knowing that he is not a attorney nor has the knowledge of an attorney. I then explain to him that is not possible for me to LEGALLY be denied my own extension of credit from my XXXX XXXX trust. I explain to them that I gave them authorization with my Social Security number and my signature to go inside of my XXXX XXXX trust and take the payment for the vehicle. ( Which the bank did ) however they stated that they did not do that and I told them that they may not do that but IN FACT the bank ( Mercedes-Benz ) does!! I also told them that they did not disclose to me what a finance charge is which is required by law. The only thing that he could say was OK I showed him the penalties for violations of the law and he said OK. The person I spoke to is XXXX ( the person who lied about being an attorney ) XXXX ( the financial manager ) and a couple of other people whose names i dont remember. I let them know that I will be submitting these complaints and that they should revise their decision before it gets bad for them. They said Ok. I didnt ask for the original document showing that I was approved with a {$40000.00} down payment they didnt give me a fraudulent document that they changed after my approval only showing that I was rejected when in fact I was approved with a {$40000.00} down payment. I told him that I knew that that was not the original document and they said OK but refused to give me the original document. my application was denied/approved with XXXX downpayment due to credit issues. How is it possible that I can be denied my own extension of credit? According to 15 U.S. Code 8 1605 - " Determination of finance '' States... ( See attachment A ) ... How could my application have been denied if my signature on my application for credit is payment of the debt? They can not deny me an extension of my own credit. According to 15 USC 1666d " Treatment of credit balances '' States " Whenever a credit balance in excess of {$1.00} is created in connection with a consumer credit transaction through ( 1 ) transmittal of funds to a creditorin excess of the total balance due on an account, ( 2 ) rebates of unearned finance charges or insurance premiums, or ( 3 ) amounts otherwise owed to or held for the benefit of an obligor, the creditor shall- ( A ) credit the amount of the credit balance to the consumer 's account ; ( B ) refund any part of the amount of the remaining credit balance, upon request of the consumer ; and ( C ) make a good faith effort to refund to the consumer by cash, check, or money order any part of the amount of the credit balance remaining in the account for more than six months, except that no further action is required in any case in which the consumer 's current location is not known by the creditor and can not be traced through the consumer 's last known address or telephone number. The creditor has furnished me with deceptive forms creating a false belief to i, XXXX XXXX, Consumer and natural person, that i have to pay that i have to pay this debt twice ( Again ) after already paying with my signature on the loan application. They have denied my application for an extension of my own credit And then went and took my signature as authorization to take the money out of my XXXX XXXX Trust. this is why they ask for the social security number and my signature, this is clearly fraud and theft!! According to 18 U.S. Code S 8- Obligation or other security of the United States defined '' States... ( See Attachment B ). They have refused to give me what i paid for. And according to the law they can not deny me an extension of my own credit from MY XXXX XXXX trust. Also they have failed to provide me and disclose to me the XXXX form required by TILA & the law. Separately upon my application. Form ; 15 U.S. Code {$1600.00} - " Determination of finance charge '' Mercedes-Benz ( the creditor/the bank ) and Mercedes-Benz ( the dealership ) also willingly and knowingly gave false and misleading/inaccurate information regarding my loan/loan application. They stated they do a finance charge and are in compliance with Truth in lending, but clearly they are not. I do not wish to pay this debt twice. Mercedes-benz ( the bank ) has 2 choices. Refund me all payment paid with my signature & ssi AND face charges of {$5000.00} per violation ( {$97000.00} ) AND/OR Give me the vehicle that I've applied for. See all attachments for proof of laws and accuracies in my natural person consumer complaint. This complaint will also be given to FTC, attorney General, and Congress. ( I know way way way way more than you think i know! I am not just a pretty young girl. Test my knowledge and you will find out and it will turn out very bad for you ) ( As u can see in the credit decision person XXXX XXXX is the one who rejected/approved with a XXXX down payment.
