Notice : New information and updated information XX/XX/22 I CLAIM Harm by way of Trespass, FRAUD and Dishonor. To CEO and Chief Compliance Officer, YOU BROKE THE LAW This is in reference to the letter sent to your company via CFPB portal dated XX/XX/22 and that letter mentioned how AMSCOT violated my consumer rights under the Fair Debt Collection Practices Act ( FDCPA ) and other violations under tittle 15 consumer protection. In response to that letter, AMSCOT replied that Amscot is a first party creditor and not a debt collector within the meaning of the Fair Debt Collections Practices Act. I am requesting you stop sending me correspondence with no material facts or sufficient evidence and show proof that you have a lawful and valid claim. I am requesting that you provide valid proof or material facts or sufficient evidence that you are a first party creditor as stated in your correspondence to me dated XX/XX/22. Please note that proof should not include a consumer contract because as per the judgement in XXXX XXXX XXXX XXXX, the consumer contract is not sufficient evidence of a debt. I am also requesting you provide to me the audit Trail of the transaction originated by you as proof of a lawful and valid claim. I am attaching here with a valid proof of you being a debt collector under provisions of FDCPA. I am demanding AMSCOT to zero out this account and remove my nonpublic personal information from all consumer reporting agencies immediately. Any failure to comply with Federal Law I will escalate this matter to Federal Court. Thank you for your corporation XXXX XXXX, AMSCOT letter showing proof that AMSCOT is attempting to collect an alleged debt under the Provisions of the Fair Debt Collection Practices Act.
