I was in a car accident on XXXX driving a brand new 2022 BMW that I had leased 3 weeks prior. The value is a {$48000.00} vehicle. The other driver rear ended me ( admitted it was his fault ) and I was just notified my car was totaled and can't be repaired. My insurance carrier is XXXX XXXX so they are now in litigation with the driver 's insurance company ( XXXX ) to get my claim paid. Until that is resolved, my insurance company has " paid '' the claim. This is where the issue is. My insurance company ( XXXX ) is paying the full value of the vehicle to BMW XXXX ( leasing company ) instead of paying them the remainder of my lease and paying me the difference. They are telling me that they had planned on paying out my lease and then paying me the difference but BMW Financial will not allow them to do it. I put {$10000.00} down on my vehicle that I had for only 3 weeks. Therefore, my insurance company is refusing to pay me what is owed back to me and paid the full amount to BMW Financial. I contacted an attorney and he said it is my insurance company 's responsibility to " make me whole again '' like I was before the accident which means they should be required to pay me the {$10000.00}. They are refusing to do so.
