I XXXX XXXX, I'm writing to put on notice the company Caine and Weiner concerning the alleged debt that is not owed. This company is listed on my XXXX and XXXX consumer reports. I learned of this alleged debt in XXXX of XXXX, by requesting my consumer reports from XXXX and XXXX. Caine and Weiner is listed there as a debt collector with the original creditor being Progressive insurance. On XX/XX/2022, I proceeded to send a debt validation letter pursuant to 15 USC 1692g. On XX/XX/2022, Caine and Weiner responded to my request pursuant to 15 USC 1692g. This letter does not validate the debt. The letter does not show any evidence of the debt owed to the original creditor Progressive. Caine and Weiner did not supply me with a purchase agreement from Progressive validating that this debt was ever owed and they now have obtained ownership to collect this alleged debt. In Caine and Weiner 's last correspondence with me, they violated 15 USC 1692f ( 8 ) Unfair Practices. Pursuant to this subchapter, a debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 8 ) Using any language or symbol, other than the debt collectors address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business. For all violations listed in this complaint, I will give photos of all correspondences between myself, and Caine and Weiner. Because they did not properly validate the debt showing any purchase agreement between Progressive insurance and Caine and Weiner of this alleged debt, I have factual evidence, which gives reason to believe that they are also in violation of 18 USC 1028 Fraud and related activity in connection with identification documents, authentication features, and information. Most insurance information in regards to a consumer disclosure report is located on the secondary credit reporting agency, XXXX XXXX. Caine and Weiner did not properly validate the alleged debt to show ownership to collect, so they are in fact in violation of 18 USC 1028. Also pursuant to 15 USC 1681b Permissible Purpose, there is no factual evidence showing any verbal, or written consent was given to Caine and Weiner to obtain any information listed on XXXX. So in closing they have no legal right obtained from Progressive insurance to collect on this alleged debt and have violated congressional laws under identity theft, the FDCPA, and also did not obtain any verbal or written permissible purpose to obtain a consumer report from any consumer reporting agency about me XXXX XXXX. I would like to request equitable remedy for Caine and Weiner, to delete this alleged erroneous debt from my consumer report on XXXX and XXXX immediately.
