On the day of XXXX XXXX I signed a contract with BMW to purchase a XXXX XXXX XXXX. At the price of XXXX with a balloon payment. I was not provided with the type of notice of my rights to rescission under the Truth in Lending Act ( TILA ), 15 U.S.C 1601et Seq this is required by federal. Upon reviewing my contract, oblations, and rights as a natural person operating in commerce, I noticed that there are several violations present which nullifies the contract pursuant 12 CFR 1026.3 named Truth in Lending. Per the Congressional finding of TILA as well as my due diligence, " It is the purpose of this subchapter to assure a meaningful disclosure of credit terms so that the consumer will be able during the consummation of the contract BMW did not disclose my right to rescind. Thus being the case, pursuant 15 USC 1635 I have the rights to rescind my initial consent to pursue the pervious terms. I conclude this letter with a demand for you to return my initial down payment since you failed to mention that my finance charge was all I needed to complete the deal and that the cash payment was only of benefit to you. 15 U.S code 1635 ( b ) ( F ) I ask that you return my Down payment of XXXX within 20 days of this notice by law. While making payments of XXXX with a very high interest rate.
