I recently discovered identity theft on 7 accounts. I sent a notice of dispute to TransUnion via certified mail on XX/XX/XXXX. The Certified Mail tracking # was XXXX XXXX XXXX XXXX XXXX. In this notice of dispute, I listed 7 specific accounts on my TransUnion consumer report that were not mine ( I included a recently filed Identity Theft Report as well ). USPS confirms that this notice was received by TransUnion on XX/XX/XXXX at XXXX XXXX in XXXX, XXXX. According to 15 U.S. Code 1681i ( a ) ( 2 ) ( A ), Before the expiration of the 5-business-day period beginning on the date on which aconsumer reporting agencyreceives notice of a dispute from anyconsumeror aresellerin accordance with paragraph ( 1 ), the agency shall provide notification of the dispute to anypersonwho provided any item of information in dispute, at the address and in the manner established with theperson. I did not receive any notification of a dispute from TransUnion before the expiration of the 5-business-day period beginning on XX/XX/XXXX. The fifth and final day/deadline was Monday XX/XX/XXXX. On Wednesday XX/XX/XXXX I called TransUnion at XXXX XXXX. My concern was in regards to a violation of 15 U.S. Code 1681i in the handling of my notice of dispute. XXXX XXXX, the first representative, tried to help when I immediately asked for a supervisor. I explained the situation and asked to speak to the legal department as I knew this was a violation of my rights. She provided case # XXXX and transferred me quickly to XXXX XXXX in the TransUnion Legal Department. XXXX was very nice, and I believe she stated factual inaccuracies that were not true. She reviewed my situation and stated that TransUnion received my notice of dispute on XX/XX/XXXX. I then provided her with the tracking number, which confirms receipt by TransUnion on XX/XX/XXXX. She even went to the USPS website to enter the tracking information and denied that it was received on that date. Perhaps her computer told her otherwise. I have also attached PS FORM 3811 which confirms the stamped receipt of my notice of dispute by TransUnion LLC on XX/XX/XXXX. If someone at their mail facility is impersonating or using the stamp/identity of TransUnion unknowingly , TransUnion should also consider filing an Identity Theft Report. After some time on the phone with XXXX, I told her I disagreed strongly with the factual inaccuracies she was stating. She misquoted dates several times and told me that TransUnion was within the timeframe allowed. She also stated that a notification letter dated XX/XX/XXXX was being sent to my home address, even though that was the 6th business day since receiving my dispute. She then advised me to file a complaint with the CFPB because they regulate us. I advised that I would wait until I received this documentation to confirm what she had told me. This documentation is, in fact, dated XX/XX/XXXX and I have attached the first page for review. According to 15 U.S. Code 1681i., TransUnion should have sent this notice in the mail or communicated with me in some manner no later than the end of business on Monday XX/XX/XXXX. This is a violation of the law and a breach of my federally protected consumer rights. I have suffered mental anguish and emotional distress by not receiving an update in a the timeframe governed by the law.
