I am writing to request this account be removed and fair investigation of my consumer profile. By reporting this account Experian is guilty of defamation of character and civilly liable. Thursday XX/XX/XXXX morning I spoke with XXXX a representative with Experian and brought to her attention several errors reporting by Experian on my personal credit report. She acknowledged verbally that my previous letter was received on XX/XX/XXXX and that a dispute was closed and a response was sent to me on XX/XX/XXXX. XXXX informed me that my attachments to my disputes were not uploaded into the Experian system and that the decision by Experian was to continue to report inaccurate, invalid, inconsistent information that is defaming my personal consumer report. - XX/XX/XXXX XXXX with XXXX XXXX XXXX confirms that she had received the death certificate for XXXX XXXX. - Experian is guilty of Truncation as it pertains to negligent and willful noncompliance with XXXX XXXX XXXX- This account is not a joint account, the vehicle loan was solely supposed to be in the name of XXXX XXXX. Please note XXXX XXXX is deceased AND her death certificate was previously sent to Experian. Experian is negligent in this right in regards to inaccuracies. - The account is reporting Auto Loan opened XX/XX/XXXX, there is no data/payment history reporting on this account from XX/XX/XXXX XX/XX/XXXX. That is two years of no history reporting. The first reporting date shows a 60 day late payment but no previous history to support this. - The status of the account is showing Charge-Off and the account reflects a monetary balance which is a contraindication of the definition of charge off. I am demanding that Experian remove this account as it has reported inaccurately and caused lenders to view me in a negative light. If this account is not deleted within 5 business days I will be seeking monetary/civil damages for defamation and negligence in Experian reporting practices. 15 U.S. Code 1681i - Procedure in case of disputed accuracy - ( 5 ) TREATMENT OF INACCURATE OR UNVERIFIABLE INFORMATION - ( A ) In generalIf, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall - ( i ) - promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the reinvestigation ; and - ( ii ) - promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer.
