On or around XX/XX/2015 I applied for a student loan. After i recently received a copy of my consumer report I noticed that these accounts are reporting inaccurately and tarnishing my reputation. There are inconsistencies Experian and XXXX states I opened the account XX/XX/2015 then XXXX is saying I opened the account XX/XX/2015. That's inaccurate information. Is this fraud? I'm confused did I open this account on that day or not? Why is there inconsistencies within this account on my consumer report? I need clarity and if they are furnishing inaccurate information this account needs to be deleted because they did not conduct an proper investigation.15 U.S. Code 1681- Congressional findings and statement of purpose. ( a ) Accuracy and fairness of credit reporting The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. ( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. ( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. ( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( b ) Reasonable procedures It is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter. ( a ) Subject to subsection ( c ) and Section 3-106 ( d ), " holder in due course '' means the holder of an instrument if : ( 1 ) the instrument when issued or negotiated to the holder does not bear such apparent evidence of forgery or alteration or is not otherwise so irregular or incomplete as to call into question its authenticity; and ( 2 ) the holder took the instrument ( i ) for value, ( ii ) in good faith, ( iii ) without notice that the instrument is overdue or has been dishonored or that there is an uncured default with respect to payment of another instrument issued as part of the same series, ( iv ) without notice that the instrument contains an unauthorized signature or has been altered, ( v ) without notice of any claim to the instrument described in Section 3-306, and ( vi ) without notice that any party has a defense or claim in recoupment described in Section 3-305 ( a ). There are so many laws being broken and me as a consumer has rights to privacy. In accordance to 15 U.S.C. 1681 Section 602 A : states I have the right to privacy. 15 U.S.C. 1681 Section 604 A Section 2 : also states a consumer reporting agency can not furnish an account without my written instructions. 15 U.S.C. 1681 states : If any person takes any adverse action with respect to any consumer that is based in whole or in part on any information contained in a consumer report, the person shall ( 1 ) provide oral, written, or electronic notice of the adverse action to the consumer ; ( 2 ) provide to the consumer written or electronic disclosure. I did not give these companies written permission to furnish anything on my credit report.
