My complaint is with CaptialOne Saks Fifth Ave. I first noticed fraudulent activity on XX/XX/2022, when there were inquiries on my credit report, but I had not recently applied for credit. I promptly initiated a credit freeze with all three credit bureaus and began working with an ID protection company. The Restoration Specialist and I have made several calls to CapitalOne to seek resolution to the fraud. A detail of events is below : I received a letter dated XX/XX/2022, stating that I was approved for a CapitalOne - Saks Fifth Ave credit card for {$3000.00}. I did not, nor have ever, applied for credit from Saks Fifth Ave. On XX/XX/XXXX, I called CapitalOne, along with my Restoration Specialist, and we spoke with XXXX. I was told the Saks Fifth Ave account was opened but " immediately suspended for suspicious activity '', that the account would be closed, and the credit bureaus would be notified to delete the inaccuracies in my reports. On XX/XX/XXXX, I noticed in my credit report that the Saks Fifth Ave account WAS opened, and someone had made fraudulent purchases on the account. We called CapitalOne again, first speaking with XXXX who told us the Saks Fifth Ave card was approved, but a XXXX XXXX card was declined. ( Note : I did not apply for either ). We then spoke with XXXX. I repeated the information about the fraud and requested the account would be closed ( as we thought it would be after the first call to CapitalOne ). XXXX said CapitalOne would initiate an investigation and that I may receive a call from a fraud adjuster to provide more information. ( This call never came ). On XX/XX/XXXX, per the advice of my Restoration Specialist, I filed a local police report to have official documentation of the fraudulent activity. I received a letter from CapitalOne dated XX/XX/2022, stating CapitalOnes investigation was complete and deemed that I would be responsible for charges totaling {$2800.00}. The reasons stated were : We received signed documents, dated prior to the date of your fraud claim, acknowledging this account is valid and Activity on the account indicated you opened an interacted with this account. I have never received copies of such signed documents, and I have never made purchases using the card -- any interaction/purchases on the account are fraudulent. According to my credit reports, the CapitalOne -Saks Fifth Ave account was closed with the outstanding balance {$2800.00}. We intend to call CapitalOne again to request they re-open the fraud/dispute investigation.
