On XX/XX/XXXX, I decided to pay off my XXXX XXXX XXXX XXXX. I brought a money order ( negotiable instrument ) to clear the debt. I added a provision to the money order which clearly states I accept your offer of {$15000.00} for valuable consideration and tender this payment for complete amount in Accord and Satisfaction upon redeeming this instrument. Under UCC 3-603 ( b ) If tender of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is is refused, there is discharge, to the extent of the amount of the tender, of the obligation of an indorser or accommodation party having a right of recourse with respect to the obligation to which the tender relates. Furthermore, under UCC 3-311, Accord and Satisfaction ( d ) knew that the instrument was tendered in full satisfaction of the claim. Westlake Financial Services received the payment, accepted the money order and then cashed it.
