Consumer Narrative

The company did not resolve the issues of inaccuracy and unverified furnished information after repeated attempts according to the FCRA and consumer laws. I also filed a complaint against the company with the XXXX XXXX XXXX for immediate assistance as this company actively reports negative inaccurate information to the 3 credit bureaus. Complaint : XXXX I am rejecting this response because : The company has not resolved the issue. The companys response and actions does not fall in accordance with 15 U.S.Code 1692g and they admitted to violating this law within their response. This U.S. Code states that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. I requested all of the verifiable documentation from the debt collectors they sold my debt to XXXX XXXX as well as XXXX XXXX XXXX XXXX. However, ALL of my request was ignored and they continued to violate more of my rights under the Fair Credit reporting ( FCRA ) by reporting inaccurate and unverified information to all of the credit reporting agencies. I want the account DELETED/ REMOVED from all of the credit reporting agencies as it continues to injure me and impact my credit negatively. I am asking the XXXX to assist in resolving this issue in accordance with 15 U.S. Code 1681i - Procedure in case of disputed accuracy ( 5 ) Treatment of inaccurate or unverifiable information ( A ) In general If, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall ( i ) promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the reinvestigation ; and ( ii ) promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer. The company underhandedly subject to the CFPB complaint removed the account as a collection and is now furnished as a closed account with a balance due. This is unacceptable because I do not owe the company. The collection company that the debt was sold to XXXX XXXX was removed because they were unable to validate or verify this debt from XXXX XXXX XXXX XXXX. I expect the same response from XXXX because the debt has not been validated nor verified in accordance with 15 U.S. Code 1692g. Admittedly ignoring my last 2 request for validation and verification in their emails regarding this complaint I expect XXXX to enforce the law that states if a debt collector can't verify your debt, then they must stop contacting you about it. And they have to let credit bureaus know so they can remove the debt from your credit report. I also understand that If a debt collector fails to verify the debt but continues to go after you for payment, you have the right to sue that debt collector in federal or state court. You might be able to get {$1000.00} per lawsuit, plus actual damages, attorneys ' fees, and court costs. Even after filing my complaint with the XXXX, the company and the collection agency representing the company consistently violated my rights under Harassing or Abusive Practices 15 U.S.C. 1692d A debt collector in collecting a debt, may not harass, oppress, or abuse any person. For example, a debt collector may not : Use or threaten to use violence or other criminal means to harm the physical person, reputation, or property of any person. The company asked for my assistance in verifying information entrusted to XXXX and consistently contacted/ harassed me via phone and email using the information obtained within my complaint.
