On XX/XX/XXXX, I sent notice to XXXX XXXX, CEO & XXXX XXXX, SENIOR VICE PRESIDENT to cease and desist any action to defame my character ( attached ). This was sent certified mail and confirmed received on XX/XX/XXXX. No response was provided from this company. The company was notified that if they failed to respond within 21 days, they accepted the debt in question as their own. Today, XX/XX/XXXX I noticed that their company has officially defamed my character on my consumer reports without consent. Not only did I try to communicate with this company to amicably work to an appropriate solution, but I also gave them notice of what would happen should they harass me in the future. These are violate business practices. Their initial document had no date, it provided no proof of their allegations, they provided no tax documentation to support their claim, and their company is not a law firm. The company decided to harass me further by harming my credit report. This is pure harassment. There is plenty of precedent that has been set by multiple honorable courts that these actions are subject to remedy in the eyes of the law. Further, this is no excuse for this companies ignorance of the law as can be seen by over 200 years of precedent. All are presumed to know the law. San Francisco Gas Co. v. Brickwedel ( 1882, 62 C. 641 ; Dore v. Southern Pacific Co. ( 1912, 163 C. 182, 124 P. 817 ; People v. Flanagan ( 1924 ), 65 C.A. 268, 223 P. 1014 ; Lincoln v. Superior Court ( 1928 ), 95 C.A. 35, 271 P. 1107 ; San Francisco Realty Co. v. Linnard ( 1929 ), 98 C.A. 33, 276 P. 368. I am not sure why this company has chosen to harass me, but as mentioned in my letter sent certified mail, I informed the company of what would happen.
