Dear Equifax, I ( XXXX XXXX ), consumer, natural person, am aware of all rights that I have, and which are protected by The Congress under the Fair Credit Reporting Act ( FCRA ). Ive submitted several requests for you to thoroughly investigate/delete Acct Number # XXXX ( XXXX XXXX XXXX XXXX ), due to you continuously failing to provide proof/verification ( copy of Consumer Contract with my Physical Signature on it ) that this account is mine. This account has violated Federal law, and my Federal protected consumer rights to privacy and confidentiality, under more than one sanction ( s ) in 15 U.S. Code 1681. 15 U.S. Code 1681 ( a ) ( 4 ) - There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. ( Equifax failed to exercise consumer privacy, by allowing this unverified account to remain on the consumer credit report, and making unauthorized changes to the consumer credit ). 15 U.S. Code 1681i ( 5 ) ( a ) - If, after any reinvestigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall ( i ) promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the reinvestigation; and ( ii ) promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer. ( Equifax failed to provide legitimate proof/verification- a copy of the XXXXonsumer Contract with the consumer Physical Signature ). 15 U.S. Code 1681i ( 5 ) ( b ) - If any information is deleted from a consumers file pursuant to subparagraph ( A ), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. ( Equifax, XXXX, and XXXX - deleted this same/exact account in XXXX, due to XXXX XXXX XXXX XXXX failing to provide legitimate proof/verification that this account is accurate. Equifax has failed to provide proof ( copy of Consumer Contract with Physical Signature on it ) that this account is accurate, and has allowed for this account to reinsert onto the consumer credit report ). 15 U.S. Code 1681i ( 3 ) ( b ) - Upon making any determination in accordance with subparagraph ( A ) that a dispute is frivolous or irrelevant, a consumer reporting agency shall notify the consumer of such determination not later than 5 business days after making such determination, by mail or, if authorized by the consumer for that purpose, by any other means available to the agency. ( Equifax failed to notify the consumer in XX/XX/XXXX, with such determination of this deleted/unverified account that is reinserted onto the consumer credit report ). 15 U.S. Code 1681a ( 3 ) ( e ) - The term investigative consumer report means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or who may have knowledge concerning any such items of information. However, such information shall not include specific factual information on a consumers credit record obtained directly from a creditor of the consumer or from a consumer reporting agency when such information was obtained directly from a creditor of the consumer or from the consumer. I demand that this account be deleted immediately. Unless you want to be held {$1000.00} per violation should this matter end up in court.
