A Federal Agency is required by law to provide minimum due process not limited to proving the debt is valid and providing for a hearing decision with an appeal process thereafter before reporting derogatory information within a credit file. The Agency has not provided minimum due process. Because a properly and timely requested hearing was never provided for, among several shortcuts and oversights, many rights where not observed and minimum due process was repeatedly violated. The credit reporting Agency was notified of these discrepancies and failed to remove the erroneous premature derogatory reporting from the credit file within investigation XXXX. I notified the credit reporting companies that the Agency must verify the account is mine to include verifying the accuracy of the account and provide a hearing were an additional appeal is available all prior to reporting the account as delinquent. The credit reporting company states the federal agency certified the account was mine with no evidence provided for such determination and the credit reporting company took no position on the derogatory 30 60 and 90 days late reportings despite substantial evidence showing the account has been paid even while pending the active dispute. In addition, the accused also timely requested consideration for a waiver should the hearing decision favor the Agency. The hearing and the waiver requests are both pended thus collection efforts by the Federal Agency to include reporting derogatory reporting are all required to stop until decided and the appeal window has expired as a matter of law.
