American Express XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX ) RE : ALLEGED CLOSED / CHARGED OFF ACCOUNT XXXX ( AMEX ) ( XXXX ) RE : ALLEGED CLOSED / CHARGED OFF ACCOUNT XXXX ( AMEX ) BOND REQUIREMENT WITH TEXAS SECRETARY OF STATES FOR DEBT COLECTORS. According to Section 392.101 of the Texas Finance Code : - ( a ) A third-party debt collector or credit bureau may not engage in Debt Collection in the State of Texas unless the third-party debt collector or credit bureau has obtained a surety bond issued by a surety company authorized to do business in this State as Prescribed by this section. The Bond must be in the amount of {$10000.00} ( XXXX XXXX Dollars ). On XX/XX/2022, I contacted Texas Secretary of State through its number XXXX to verify if American Express has an active surety Bond with Texas Secretary of State and was told by XXXX XXXX that American Express does not have an active surety Bond with Texas Secretary of States as such your company will be in violation of Section 392.101 of the Texas Finance Code if your company attempts to collect any debt within the State of Texas. Also, a search of Texas Secretary of State XXXX XXXX XXXX XXXX DID NOT return any active Bond information for American Express with Texas Secretary of States . I have attached result of my search to this complaint. * Please, kindly confirm if American Express has an active surety bond with Texas Secretary of State. Trying to collect an alleged debt without having an active surety bond with Texas Secretary of State IS A VIOLATION OF SECTION 392.101 OF THE TEXAS FINANCE CODE.
