On or about XX/XX/XXXX XXXX XXXX XXXX Account # : XXXX placed derogatory remarks on my credit report. Upon, further research, this account was transferred/sold, and I am no longer responsible for the account. Debtor 's creditor did not verify this collection. Also, there was NO written form of communication, contract, or written signature for this accused debt at all. A bill without a signature does not validate the debt and anybody can send a bill and say its mines. Furthermore, the alleged charge off date on the account is XXXX XXXX. XXXX XXXXXXXX XXXX is claiming to have obtained this debt in XXXX XXXX I informed XXXX XXXX XXXX the account was not mines several times to no avail. My consumer reports show inaccurate open dates, account status of OPEN on XXXX and Equifax and a status of CLOSED on XXXX. There is NO payment history on XXXX, the payment history for Equifax shows positive, missing, and late payment history on a closed account, and XXXX reports collections. These discrepancies prove that the consumer bureaus did not validate this debt and are purposely reporting inaccurate information! According to Section 16.004 of the Texas Civil Practice and Remedies Code : The statute of limitations on debt in Texas is four years. Section 392.307 of the Texas Finance Code ; states that a payment on the debt ( or any other activity ) does not restart the clock on the statute of limitations. It also requires that debt buyers provide written notice to a consumer if the limitations period has expired. According to the FCRA. XXXX XXXX XXXX has violated my rights as a consumer and I'm requesting legal action to remove this account immediately. Unfortunately for myself, I am just becoming aware of laws regarding my consumer rights. However, I plan to become knowledgeable of the law and will hold individuals who disregard the law accountable for their actions. My reputation has been severely tarnished due to these negative, inaccurate remarks which is completely unfair. Therefore, I am filing a formal complaint against said company today for their blatant disregard for the law and failure to protect the consumer : Me!
