Dear CFPB, Please find my complaint against Wells Fargo bank and my demand to provide me name and contact information for an authorized Trust officer in XXXX XXXX as Trustee for XXXX XXXX who can confirm Wells Fargo robo-employees information and explain why XXXX XXXX as Trustee and XXXX XXXX as Trustor both deny its involvement in this fraudulent foreclosure case and TWO sales of my property one on XX/XX/XXXX purportedly to XXXX XXXX as Trustee for XXXX XXXX and one by XXXX XXXX who sold for {$130000.00} on XX/XX/XXXX. MLS # XXXX. I specifically demanded a proof of receipt of these money, {$130000.00} from sale on XX/XX/XXXX and a lien release from XXXX XXXX as Trustee for XXXX XXXX Both, XXXX XXXX and XXXX XXXX DENY its involvement in my transaction and this foreclosure which creates a reasonable question whom Wells Fargo is purportedly servicing all this time ; who purchased my property on XX/XX/XXXX ( if XXXX XXXX was listed as a buyer ) ; who sold my property on XX/XX/XXXX if the Seller was XXXXXXXX XXXX who deny it ; who received {$130000.00} from this sale and who had authority to sell it if XXXX XXXX deny its involvement and who must provide me a release of my alleged lien. I demand Wells Fargo and XXXX XXXX to provide me name of responsible employee at XXXX XXXX as Trustee who can verify Wells Fargo authority as a Servicer to respond to my unquiries ; a copy of receipt of {$130000.00} after XX/XX/XXXX sale of my property ; a copy of the accounting ledger and a release of lien from XXXX XXXX as Trustee. Despite Wells Fargo attempts to cover for this crime, it is not resolved and will not be resolved until my property is returned back to me as well as all illegally collected from me money stolen for repayment of non-existing virtual loan. XXXX XXXX property was returned to its lawful owners after 100 years, which set a notable precedent. My case was not a foreclosure. It was illicit abuse of process which is fraudulent to its core. A foreclosure, by definition, is limited to the enforcement of a security instrument in which ownership of the instrument and the underlying obligation is vested in a creditor who is named as the claimant. With very few exceptions, none of the foreclosures over the last 25 years have satisfied the definitions or conditions precedent for the filing of a foreclosure action. Virtually all of them are 100 % reliant on the presentation of fabricated documents containing false information about transactions that never occurred. Those documents memorialize nonexistent transactions. They are all legal nullities. Although hundreds of people in government, perhaps thousands, have understood this from the beginning, the decision made at the top ( based on false information ) was to sacrifice homeowners ( and veterans ). This policy is based upon the erroneous presumption that the entire economy would collapse if the truth about the transactions with homeowners was revealed. This policy from the top is the only thing supporting the big lie : that the transactions with homeowners were originated as loans and maintained as such on the books of creditors. Nothing could be further from the truth. But because of general acceptance of the big lie, lawyers from foreclosure mills and judges routinely ridicule or even get mad at homeowners who raise proper and timely objections to allegations and purported evidence of the existence of an unpaid loan account receivable owned as an asset on the books and records of an identified creditor. There is no such thing as a virtual loan account, and there is no law support for enforcing a virtual loan account. And to put a finer point on it, veterans like myself, on or off the battlefield should be protected, and court officers should be held to a much higher standard of care in foreclosing and evicting people who put their lives on the line so we could even have these discussions. Such persons should be held in the highest esteem, and policy should favor the highest priority in protecting them from any hint of overreaching, unconscionable, or fraudulent business practices. I was defrauded through the weaponization of the foreclosure procedures that were not known or understood by me, and I had no access to such information and have been deprived of such information by the securitization actors who intentionally withhold such information and even disseminate disinformation. Thus, this fake foreclosure for profit was completely illegal and inequitable.
