CFPB, do not close this complaint as a duplicate OR send it to another agency. This complaint directly involves issues monitored by the CFPB including how Creditors report inaccurate or incomplete information to credit bureaus, and I expect your help with it. These issues remain unresolved after complaints through all other possible means, and I want this company held accountable for it. I asked XXXX XXXX Bank nicely to remove adverse credit file information like the late payments from my credit file due to XXXX. They refused. They went the extra step to say they are not allowed to remove negative information based on the FCRA. That is a self-serving, inaccurate, perversion of the legislation. The FCRA exists to prevent companies from reporting false, negative, information about consumers. There is no law or legislation that exists which prevents nor encourages them not to, remove adverse credit file information from individual 's reports that have found to be XXXX XXXX and/or XXXX. I have documentation that I was not XXXX XXXX to manage this account, and I want the adverse credit file information removed. Lastly, not only has this company refused to remove negative information, but they violated my FCRA rights by removing the POSITIVE information associated with this account by refusing to report payments made on time. Companies are not allowed to report negative information in the absence of the positive information. So unethical. This company knows good and well that I am XXXX, my spouse is XXXX, we qualify for title 47 protection, and they are persecuting us with negative information that does not benefit their company in absolutely any way. My spouse and I, BOTH, have been declared totally and permanently XXXX. We are in unsafe housing due to low credit scores because of companies like XXXX XXXX that are persecuting us while other companies, with ethics, readily agreed to delete the adverse information in light of our XXXX status and unsafe situation. They are not breaking the law in doing so. They are upholding the law, as well as ethics and basic human decency. I expect XXXX XXXX to do the same. I also expect the credit bureaus to stop letting companies get away with things like this. They know good and well when a company is not reporting a complete payment history and is only reporting late payment information. Unacceptable. See attached documentation of permanent and total XXXX status. Attention XXXX XXXX Bank, XXXX, and Experian ; I am done with being discriminated against based on my XXXX status. Being so harshly penalized for issues beyond my control due to my XXXX, and inability to advocate for myself, that my credit scores have been trashed to the point I can not obtain safe housing for myself, my XXXXXXXX XXXX XXXX spouse, or my small child. I am done with this discrimination and penalization for XXXX. My next course of action will be to take this matter to the United States Office of Civil Rights and file a formal complaint, followed by an OCR violation and FCRA violations lawsuit when that complaint is unresolved. There is a reason XXXX XXXX Bank has been widely publicized as " America 's Worst Credit Card ... Huge interest rates, high fees, and a XXXX eye from Consumers Union : XXXX XXXX Bank ranks as the countrys most dangerous plastic. XXXX XXXX reports on the Feds new crackdown ( XXXX XXXX ). '' How dare they, a company known for being so predatory, tell me deleting derogatory information directly related to XXXX twice over a XXXXXXXX XXXXt vet and a XXXX XXXX XXXX woman with XXXX would violate the Fair Credit Reporting Act.
