I am a victim of identity theft. I have contacted Upgrade since last year and they refuse to resolve anything. They can not provide validation of the debt and continue reporting a negative tradelineon my credit report. If they can not provide the following information, I want the negative tradeline to be removed from my credit report. Upgrade, I demand the following : It is my right that under the FCRA 15 U.S.C. 1681i, all unverified accounts must be promptly deleted. Therefore, if you are unable to provide me with a copy of the verifiable proof that you have on file for each of the accounts listed below within 30 days of receipt of this letter then you must remove these accounts from my credit report. 1. That Upgrade Inc is complying with all applicable Federal Reserve Policies and Procedures, Federal laws, and State laws requiring the use of Generally Accepted Accounting Principles and Generally Accepted Auditing Standards for all bookkeeping entries associated with performing the Agreement. 2. Audited bookkeeping entries showing assets/liabilities for the account in question. 3. Copy of form 1099 filed by Upgrade Inc regarding the account in question. 4. Copy of insurance policies associated with this account. Please do not confuse this request with a request for copies of any billing statements or a request for copies of any standard cardholder agreements. This is not such a request. Providing those items will verify nothing without the other requested documents.
