I inherited my mother 's house in XXXX. She had a reverse mortgage and I was trying to work with Novad and HUD to save it from foreclosure. A lot has happened since then. I am XXXX and was in the XXXX for a while. During this time I was communicating on and off with Novad about what would happen, but they were hard to get ahold of. I thought they were going to work with me to let me stay in the home but in XX/XX/XXXX I got a notice that a foreclosure sale was scheduled for XX/XX/XXXX. I needed more time to figure out what to do and if there was a chance I could save the house. A legal aid attorney told me that I could request a COVID-19 extension to the foreclosure deadline. She told me to call Novad, explain that I was an heir to the property, and ask for the extension. In XX/XX/XXXX I tried calling Novad many times. I could never get through. I would have to leave my number and wait for a callback. I finally got a callback on XX/XX/XXXX but all the representative would say was that I had to pay over {$480000.00} to stop the sale. I tried calling Novad again and again couldn't get through and had to wait for a callback. On XX/XX/XXXX I called the HUD XXXX XXXX XXXX with my lawyer but they told us there was nothing they could do and I had to wait for the callback from Novad before I could escalate my urgent request. On XX/XX/XXXX I finally talked to Novad XXXX XXXX XXXX, who told me there was nothing she could do and she couldn't give me an extension. My lawyer also tried to call and email XXXX and other contacts at Novad and HUD, including the XXXX and XXXX email addresses. Her correspondence is attached. She could not reach anyone by phone and when she finally got an email response from Novad, it again refused the extension request. HUD XXXX XXXX XXXX says that borrowers and their heirs with HECMs in a Due and Payable status may request an automatic extension while the COVID national emergency is ongoing, with the extension lasting until XX/XX/XXXX. As a confirmed successor in interest, I am considered to be acting in the shoes of the borrower. See Regulation X 12 CFR 1024.30 ( d ). Also, CFPB guidance says " As an eligible non-borrowing spouse or heir, you may ask for an extension. In fact they seemed to not know about this guidance at all. I ended up filing for bankruptcy because I was so stressed about the foreclosure sale and having to move out of my house right away.
