Consumer Narrative
I was attempting to sell an item on XXXX XXXX, and was contacted by a buyer ( XXXX XXXX ) on XXXX XXXX on XX/XX/XXXX. He said that he tried to send me money through Zelle, but that I had to update my account to a business account to continue with the transaction. I would have to send him {$100.00} to do so, and I did this through Zelle. I got a message saying that " I have a pending payment of {$220.00} USD. We should be crediting your account now but we noticed the account has been limited and not a business account so it can't be credited so we need you to contact the buyer to send in the amount of {$200.00} USD to your Zelle account so it can be changed to a business account be credited immediately with $ XXXX into your account. '' I sent him another {$200.00} through Zelle. The email he used for Zelle was XXXX and the alias used was XXXX XXXX. The " buyer '' asked for screenshots of my transactions. He also repeatedly tried to call me using XXXX XXXX. I did not answer these calls, as I was at work. I blocked the seller from sending any further messages. I called XXXX that day ( XX/XX/XXXX ) to report the scam. They told me they could not do anything until the money was actually deducted from my account. I called back on XX/XX/XXXX, after the money had left my account, and formally filed a dispute. I also filed a police report with the XXXX XXXX Police Department, and a complaint with the FBI Internet Crime Complaint Center. I received a letter from XXXX, dated XX/XX/XXXX saying that my dispute has been denied. I believe I am protected by the Electronic Fund Transfer Act. In XX/XX/XXXX, the Consumer Financial Protection Bureau clarified its position on banks ' required compliance with the Electronic Fund Transfer Act of XX/XX/XXXX, also known as Regulation E. The CFPB says that " if a third party fraudulently induces a consumer into sharing account access information, '' that consumer should receive the same protections as if the money were acquired from a stolen debit card or other banking " access device.
